Terms and Conditions for Accommodation Contracts

Article 1. Scope of Application
  1. Contracts for accommodation and related agreements to be entered into between The Flow Kamakura and the guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided for herein shall be governed by laws and regulations and/or generally accepted practices.
  2. The Flow Kamakura may enter into a special contract with the guest, through the content on the website at the time of the reservation, notifications sent by The Flow Kamakura after a reservation is confirmed, etc. (hereinafter referred to as “Special Contract”). Insofar as such Special Contract does not violate laws and regulations and/or generally accepted practices, notwithstanding the preceding Paragraph, the Special Contract shall take precedence over the provisions of these Terms and Conditions.
Article 2. Application for Accommodation Contracts
  1. A guest who intends to make an application for an accommodation contract with The Flow Kamakura shall notify The Flow Kamakura of the following particulars: 
    1. (1)Name and contact information of the guest(s);
    2. (2)Date(s) of accommodation and estimated time of arrival; 
    3. (3)Accommodation Charges; and 
    4. (4)Other particulars stipulated by laws and regulations or deemed necessary by The Flow Kamakura
  2. In cases where the guest requests, during their stay, an extension of accommodation beyond the date(s) in Subparagraph (2) of this Article, it shall be regarded as an application for a new accommodation contract at the time such a request is made.
Article 3. Conclusion of Accommodation Contracts, etc.
  1. A contract for accommodation shall be deemed to have been concluded when The Flow Kamakura has duly accepted the application as stipulated in the preceding Article. However, the same shall not apply when it has been proved that The Flow Kamakura has not accepted the application.
  2. When a contract for accommodation has been concluded in accordance with the provisions of the preceding Paragraph, the guest is requested to pay an accommodation deposit by the date specified by The Flow Kamakura.
  3. The deposit shall be first used for the total accommodation charges to be paid by the guest, then secondly for the cancellation charges under Article 6 and thirdly for the reparations under Article 18 as applicable, and the remainder, if any, shall be refunded at a later date.
  4. When the guest has failed to pay the deposit by the date as stipulated in Paragraph 2 of this Article by the means designated by The Flow Kamakura, the accommodation contract shall be treated as invalid. However, the same shall apply only in the cases where the guest has been informed by The Flow Kamakura of the stipulation of this Paragraph in advance.
Article 4. Special Contracts Requiring No Accommodation Deposit
  1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, The Flow Kamakura may enter into a special contract requiring no accommodation deposit after the contract has been concluded as stipulated in the same Paragraph.
  2. In cases where The Flow Kamakura has not requested the payment of a deposit as stipulated in Paragraph 2 of the preceding Article and/or has not specified the deadline for the payment of a deposit at the time the application for an accommodation contract has been accepted, The Flow Kamakura shall be treated as having accepted a special contract as described in the preceding Paragraph.
Article 5. Refusal of Accommodation Contracts
  1. The Flow Kamakura may not accept the conclusion of an accommodation contract under any of the following cases:
    1. (1)When the application for accommodation does not conform with the provisions of these Terms and Conditions;
    2. (2)When The Flow Kamakura is fully booked and no room is available;
    3. (3)When the guest seeking accommodation is deemed liable to conduct themselves in a manner which will contravene the laws or act against the public order or good morals in regard to their accommodation; 
    4. (4)When the guest seeking accommodation is considered to be corresponding to the following (a) to (c).
      1. (a) A gang group as defined under the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act Number 77 of 1991) stipulated in Item 2 of Article 2 (hereinafter referred to as “a gang group” or “gang groups”), a gang member stipulated by the same Act in Item 6 of Article 2 (hereinafter referred to as “a gang member” or “gang members”), a gang group semi-regular member, a gang member-related person, or other antisocial group.
      2. (b) A corporate entity or other organization in which gang groups or gang members control business activities.
      3. (c) A corporate entity with gang groups or gang members serving as corporate officers;
    5. (5)When the guest seeking accommodation causes or may objectively be liable to cause considerable inconvenience to The Flow Kamakura, persons concerned, or the residents in the neighboring communities;
    6. (6)When the guest seeking accommodation can be clearly detected to be carrying an infectious disease;
    7. (7)When the guest seeking accommodation is violent, or makes demands beyond a reasonable purview;
    8. (8)When The Flow Kamakura is unable to provide accommodation due to natural calamities, malfunction of facilities and/or other unavoidable causes;
    9. (9)When the provisions of the prefectural ordinance apply; or
    10. (10)When the guest seeking accommodation does not comply with the Use Regulations, House Rules, etc. set out by The Flow Kamakura.
Article 6. Right to Cancel Accommodation Contracts by the Guest
  1. The guest is entitled to cancel their accommodation contract by so notifying The Flow Kamakura.
  2. In cases where the guest has canceled the accommodation contract in whole or in part due to causes for which the guest is liable (except in the case where The Flow Kamakura has requested the payment of the deposit during the specified period as described in Paragraph 2 of Article 3 and the guest has canceled before paying the deposit), the guest shall pay cancellation charges as listed in the attached Table 2. However, in cases where a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, the same shall apply only when the guest is informed of the obligation of the cancellation charges in case of cancellation by the guest.
  3. In cases where the guest does not appear by 22:00 of the accommodation date without an advance notice, The Flow Kamakura may regard the accommodation contract as being cancelled by the guest.
Article 7. Right to Cancel Accommodation Contracts by The Flow Kamakura

The Flow Kamakura may cancel the accommodation contract under any of the following circumstances:

  1. When the guest is deemed liable to conduct and/or has conducted themselves in a manner which will contravene the laws or act against the public order and good morals in regard to their accommodation;
  2. When the guest is clearly considered to be corresponding to the following (a) to (c). 
    1. (a) A gang group, gang group semi-regular member, gang member-related person, or other antisocial group. 
    2. (b) A corporate entity or other organization in which gang groups or gang members control business activities.
    3. (c) A corporate entity with gang groups or gang members serving as officers;
  3. When the guest causes or may objectively be liable to cause considerable inconvenience to The Flow Kamakura, persons concerned, or the residents in the neighboring communities;
  4. When the guest can be clearly detected to be carrying an infectious disease;
  5. When the guest is violent, or makes demands beyond a reasonable purview;
  6. When The Flow Kamakura is unable to provide accommodation due to natural calamities and/or other causes of force majeure;
  7. When the provisions of the prefectural ordinance apply; or
  8. When the guest dose not observe prohibited actions, such as smoking in bed, engaging in loud conversations which reach outside, causing noises with musical instruments, etc., and other prohibitions of the Use Regulations stipulated by The Flow Kamakura (restricted to particulars deemed necessary in order to prevent fires).
Article 8. Registration
  1. The guest shall register the following particulars on the day of accommodation by the means specified by The Flow Kamakura:
    1. (1)Name, age, sex, address and occupation of the guest(s);
    2. (2)Except in the case of a Japanese national or Japanese resident, nationality, passport number, port and date of entry in Japan;
    3. (3)Date and estimated time of departure; and
    4. (4)Other particulars which are stipulated by laws and regulations or are deemed necessary by The Flow Kamakura.
  2. In principle, the guest shall pay their accommodation charges prescribed in Article 12 by credit card. However, in cases where The Flow Kamakura designates another means of payment, the guest shall observe The Flow Kamakura’s instructions.
Article 9. Occupancy Hours of Suites
  1. The guest is entitled to occupy the contracted suite(s) of The Flow Kamakura from 3:00 p.m. to 10:00 a.m. the next day. However, in cases where the guest is accommodated continuously, the guest may occupy the suite(s) all day long, except for the days of arrival and departure. However, in cases where The Flow Kamakura enters into a special contract with the guest, the provisions of the special contract shall take precedence over the provisions of these Terms and Conditions.
  2. The Flow Kamakura may, notwithstanding the provisions prescribed in the preceding Paragraph, permit the guest to occupy the room beyond the time prescribed in the same Paragraph. In such cases, extra change shall be paid as specified by The Flow Kamakura.
Article 10. Observance of Use Regulations

The guest shall observe the Use Regulations established by The Flow Kamakura, which are posted within the premises of The Flow Kamakura.

Article 11. Business Hours

The business hours of the main facilities, etc. of The Flow Kamakura shall be specified in the Use Regulations.

Article 12. Payment of Accommodation Charges
  1. The breakdown of the accommodation charges, etc. that the guest shall pay is as listed in the attached Table 1.
  2. In principle, accommodation charges, etc. as stated in the preceding Paragraph shall be paid by credit card prior to the check-in date. However, in cases where The Flow Kamakura designates another means of payment, the guest shall observe The Flow Kamakura’s instructions.
  3. Accommodation charges shall be paid even if the guest voluntarily does not utilize the accommodation facilities after such facilities have been made available to them by The Flow Kamakura.
Article 13. Liabilities of The Flow Kamakura
  1. The Flow Kamakura shall compensate the guest for the damage if The Flow Kamakura has caused such damage to the guest in the fulfillment or the nonfulfillment of the accommodation contract and/or related agreements. However, the same shall not apply in cases where such damage has been caused due to reasons for which The Flow Kamakura is not liable, or where such damage is indirect and a causal relationship between The Flow Kamakura’s liability and such damage is unclear.
  2. The Flow Kamakura is covered by liability insurance for emergencies such as fire. However, the same shall not guarantee that all damage incurred is compensated. 
  3. The Flow Kamakura may suggest meal or activity options. Such options are offered based on a direct contract between the guest and the providers, and therefore, The Flow Kamakura is liable for any issues arising from such contract. Please ensure to carefully review the conditions before entering into a contract.
Article 14. Arrangement When Unable to Provide Contracted Suites
  1. The Flow Kamakura shall, when unable to provide contracted suite(s), strive to arrange accommodation of the same standard elsewhere for the guest as far as practicable with the consent of the guest.
  2. When arrangement of other accommodation cannot be made notwithstanding the provisions of the preceding Paragraph, The Flow Kamakura shall pay the guest a compensation fee equivalent to the cancellation charges and the compensation fee shall be applied to the reparations. However, when The Flow Kamakura cannot provide accommodations due to reasons for which The Flow Kamakura is not liable, The Flow Kamakura will not pay the compensation fee to the guest.
Article 15. Handling of Deposited Articles

The Flow Kamakura does not accept deposited articles from the guest.

Article 16. Custody of Baggage and/or Belongings of the Guest 
  1. The Flow Kamakura does not keep the baggage of the guest prior to their accommodation.
  2. When the baggage or belongings of the guest is found left behind after their check-out, and the ownership of the article(s) is confirmed, The Flow Kamakura shall inform the representative of the guest group. When the owner of the article(s) is clearly identified, The Flow Kamakura shall seek instructions on the handling of such article(s). In cases where The Flow Kamakura is not able to receive said instructions or identify the owner of the article(s), The Flow Kamakura shall keep the article(s) for seven (7) days and dispose of it. Food, newspapers, magazines, etc. shall be discarded on the same day as they are found. Valuable items shall be kept for a certain period of time and then turned over to the nearest police station.
  3. In regard to the preceding Paragraph, The Flow Kamakura bears no liability for the articles left behind after the guest’s check-out.
Article 17. Liability regarding Parking

The Flow Kamakura shall not be liable for the custody of the vehicle of the guest when the guest utilizes the parking space within the premises of The Flow Kamakura, as it shall be regarded that The Flow Kamakura simply offers the space for parking. However, The Flow Kamakura shall compensate the guest for the damage caused through intention or negligence on the part of The Flow Kamakura in regard to the management of the parking space.

Article 18. Liability of the Guest

The guest shall compensate The Flow Kamakura and/or persons concerned for any damage caused through intention or negligence on the part of the guest.

The percentages signify the rate of cancellation charge to the total accommodation charges including tax. 

After 22:00 shall be regarded as the following day. 

Above cancellation charges and cancellation policy also apply when the number of contracted accommodation days is shortened during the guest’s stay. 

In cases where a third-party booking website has special stipulations, the same shall take precedence over these cancellation charges and cancellation policy.
